What is Mediation?

  • Mediation is a conflict management process that is geared toward problem solving.
     
  • Mediation is informal and confidential.
     
  • Mediation is conducted by a third party - the Mediator. Mediators are neutral (as to the participants) and impartial (as to the outcome). The mediator has no decision-making power, instead the Mediator facilitates discussions between the parties, aiming for a voluntary and mutually acceptable resolution to their dispute.
     
  • Mediation is a time for negotiation, opening up the channels of communication, articulating and/or re-framing the needs of each participant, identifying the issues, fostering problem solving, providing information and options, and exploring settlement alternatives.

Mediation can be conducted with or without attorneys. Prior to signing any legal document (especially in cases of divorce) parties are encouraged to consult with independent legal counsel.
